1. Acceptance of Terms
By accessing this website, creating a portal account, requesting a market scan, uploading documents, or using GovScoutIntel services, you agree to these Terms of Service. If you are using the services on behalf of a company, you represent that you have authority to bind that company.
2. Services Provided
GovScoutIntel provides GovCon market intelligence, opportunity monitoring, bid/no-bid support, capture planning, proposal-readiness support, analyst-reviewed reports, and related advisory services. The services may include portal access, automated workflows, third-party data sources, report generation, email notifications, and human review.
3. Human Review and No Autonomous Submission
GovScoutIntel is designed for human-approved decision support. We do not make final bid/no-bid decisions for you, sign documents for you, certify your eligibility, or submit proposals on your behalf unless a separate written agreement specifically authorizes a limited support activity. Final review, approval, certification, pricing, compliance, and submission responsibility remain with the client.
4. Account Access and Security
You are responsible for keeping login credentials confidential, limiting portal access to authorized personnel, and promptly notifying us of suspected unauthorized access. We may suspend access to protect the platform, client data, or system integrity.
5. Client Data and Uploaded Materials
You are responsible for ensuring that information you submit is accurate and that you have the right to provide it. Uploaded materials may be used to prepare reports, score opportunities, support capture analysis, maintain audit trails, and operate the portal. Do not upload classified, export-controlled, or restricted information unless we have a written agreement confirming appropriate handling requirements.
6. Third-Party Data and Availability
Market intelligence may rely on public data, government systems, API providers, client-provided information, and third-party sources. We work to provide timely and useful analysis, but source data can be incomplete, delayed, changed, withdrawn, or unavailable. We do not guarantee the availability, accuracy, completeness, or continued accessibility of third-party data sources.
7. No Guaranteed Contract Awards
GovScoutIntel improves pursuit visibility and decision support, but it does not guarantee contract awards, revenue, bid acceptance, agency response, proposal success, set-aside eligibility, or a specific win rate.
8. Compliance Responsibility
Clients remain responsible for verifying solicitation requirements, registrations, representations and certifications, pricing, labor categories, insurance, bonding, socioeconomic eligibility, subcontracting requirements, and all applicable laws and procurement rules. GovScoutIntel reports and recommendations are decision-support materials, not legal, accounting, or procurement-law advice.
9. Fees, Billing, and Plans
Fees and service levels are described on the pricing page, in an order form, invoice, or separate service agreement. If online payments are enabled, payment processing may be provided by Stripe or another provider. If pilot access is enabled, billing may be disabled until a paid plan is selected.
10. Acceptable Use
You may not misuse the portal, attempt unauthorized access, interfere with system operations, reverse engineer platform components, upload malicious code, scrape data in violation of law or third-party terms, or use the services for unlawful, misleading, or abusive activity.
11. Intellectual Property
The website, platform design, workflows, templates, scoring logic, reports, graphics, and service materials are owned by GovScoutIntel or its licensors. Client-owned materials remain the client’s property. Subject to payment and these terms, clients may use delivered reports internally for business-development and capture purposes.
12. Confidentiality
Each party will use reasonable care to protect non-public business information received from the other party. Confidentiality obligations do not apply to information that is public, independently developed, already known without restriction, or lawfully received from another source.
13. Disclaimers
The services are provided on an “as available” basis. To the fullest extent permitted by law, GovScoutIntel disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.
14. Limitation of Liability
To the fullest extent permitted by law, GovScoutIntel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost opportunities, procurement losses, or data loss. Our aggregate liability for claims related to the services will not exceed amounts paid to GovScoutIntel for the applicable services during the three months before the claim arose.
15. Changes to Services or Terms
We may update the services or these terms as the platform evolves. Material updates will be reflected on this page or communicated through appropriate channels. Continued use after updates means you accept the revised terms.
